Sette anni di carcere per aver
protestato contro la guerra. Questa è la sentenza che il
Tribunale di Firenze ha emesso il 28 gennaio 2008 per 13 manifestanti
che il 13 maggio 1999, in occasione dello sciopero generale del
sindacalismo di base contro la guerra della Nato nella ex Jugoslavia,
“resistettero” alle cariche sotto il Consolato Usa. 7 anni per resistenza aggravata. E’
chiaro che l’unica aggravante in una sentenza così
vergognosa è quella politica. La stessa volontà di
vendetta presente nella sentenza di Genova, Torino, Cosenza e nelle
inchieste e nei processi di Bologna e Milano.
Queste sentenze vogliono sancire lo
slittamento del conflitto sociale all’interno della normativa penale.
Una normativa ed un diritto penale, che rimane legato al Codice Rocco
del ventennio fascista, e prevede di fatto tali pene (fino a 15 anni)
così pesanti per reati connessi all’ordine pubblico, come
quello di resistenza a pubblico ufficiale. Per lo stato la
conflittualità politica non è ammessa, e
l’incompatibilità con il sistema istituzionale si paga a
caro prezzo. Declinare e rinchiudere 10 anni di movimento nelle aule
giudiziarie, questo crediamo sia il senso di questa come di
innumerevoli altre storie giudiziarie.
Sperimentare la tenuta di "nuovi"
reati, quali devastazione e saccheggio, mantenendo i "vecchi"
resistenza e danneggiamento. Dal 1999 in poi, anno della guerra nei
Balcani, innumerevoli sono le inchieste e le condanne per reati che
vanno dai danneggiamenti ai blocchi contro le grandi opere,
dall’associazione sovversiva alla resistenza, dalle occupazioni di
case e spazi sociali. I provvedimenti legislativi servono a
qualificare tutte le forme di insorgenza come emergenza ed a dettare
continui stati di eccezionalità.
La vera emergenza riteniamo sia
quella dell’agibilità dell’iniziativa politica. Ed in
questo senso questa è una sentenza che parla a tutti. Non c’è
più spazio per una critica al sistema. Non si deve
manifestare, tanto meno contro la guerra.
Quella di Firenze è una
sentenza che va oltre ogni misura e rappresenta uno strappo nello
stesso tessuto giuridico-repressivo del paese. E’ una sentenza che
lancia un messaggio preciso: tutti da punire severamente, in questo
caso con 7 anni di carcere per avere manifestato contro la guerra.
Di fronte a quello che sta
succedendo a Firenze e non solo, crediamo non si possa e non si debba
stare zitti. Crediamo necessaria una mobilitazione forte e
continuativa che sappia far vivere questo processo in città e
non solo. Una mobilitazione che sappia rispondere al significato
politico delle sentenze e nello stesso tempo costruisca e faccia
crescere il movimento: per rispondere ai tentativi di criminalizzare
con una generalizzazione delle pratiche conflittuali e con la
capacità di mettere davanti la solidarietà alle
divisioni. Un movimento capace di tenere alta la testa e di
rovesciare la sentenza di Firenze e le altre analoghe.
Proponiamo una assemblea cittadina
per il giorno 20 febbraio alle ore 21.30 all’Archivio ’68 in Via
Giampaolo Orsini, e sabato 1 marzo, ad un mese dalle condanne, una
giornata di mobilitazione e solidarietà con corteo.
